If you are caught driving under the influence of alcohol and/or drugs on federal property, you will be charged for with a federal DUI. This means you will have to attend federal court instead of state court for your DUI proceedings. Federal courts oftentimes will sentence you using more severe penalties. There are two different ways which you can be tried for DUI under federal law. The first occurs if you are convicted of DUI on land that is governed by the National Park Service, wherein you would be tried under the Code of Federal Regulation. If you are charged with DUI on any other type of federal property, you will be charged in federal court using current Florida state laws and penalties through the Assimilative Crimes Act.
The federal DUI process is similar to the state DUI process in that if you are pulled over for driving under the influence of alcohol and/or drugs on federal property, you will be asked to take a chemical test to measure your BAC (blood alcohol concentration) such as a blood, breath or urine test. If you refuse, you will automatically be arrested for a DUI.
If convicted for a federal DUI, you can be sentenced to federal penitentiary or prison, fines, probation, DUI School, and you may lose your right to drive on federal property. Also, depending on the circumstances and severity of your case you may face additional penalties.
