What should I do if I have just been arrested for DUI (driving under the influence) in Florida?

If you have just been arrested for DUI in Florida, it is important that you remain silent until you contact an attorney to represent you. Can I refuse to take a breath or a blood test when suspected of a DUI?

Yes. You have the right to refuse either test. Keep in mind however that you will most likely be arrested and charged with a DUI. In addition, refusing breath and blood tests will lead to the automatic suspension of your driver’s license, under Florida’s Implied Consent laws.

What if this is my third offense?

If this is your 3rd DUI within the past 10 years, you will be charged with a felony. You will also be looking at a sentence of 5 years in prison, steep fines, a 5 year minimum driver’s license suspension, community service, mandatory DUI school and probation. In addition your vehicle most likely will be impounded and you may receive an ignition interlock device placed in your vehicle.

What does it mean when law enforcement impounds your vehicle?

When a vehicle is impounded, it is taken by law enforcement or with law enforcement’s permission, to an impoundment yard for a set number of days. After that time is up, you will need to pay a towing charge along with a large storage fee to have your vehicle returned to you.

What is an ignition interlock device?

An ignition interlock device is very similar to a breathalyzer machine. It is installed in the dashboard of a car, and you must breathe into a device which will measure your BAC (blood alcohol concentration) before your car will turn on. If your BAC is above the legal limit of 0.08% then your car will not start, thus preventing any further DUI-related incidents.
