Case Tips Regarding Your Florida DUI

The following are several tips that we recommend to anyone who has been arrested or charged with a state or federal DUI offense in Florida:

  • Retain an experienced DUI defense attorney to represent you. Only an experienced DUI defense attorney can obtain the best possible outcome for your DUI case.

  • Politely decline to take any field sobriety tests or blood, breath or urine tests. You have the right to refuse to take any of these tests. They are voluntary, regardless of what law enforcement may tell you. Declining these tests will help you to obtain more favorable results regarding your DUI arrest. However, refusing to take a test to determine your blood alcohol concentration will result in the automatic suspension of your driver’s license, regardless of whether you are found guilty of DUI or not.

  • Politely refuse to answer any of the officer's questions concerning your DUI arrest unless your lawyer is present.

  • Politely decline a law enforcement officer’s request that you take a Preliminary Alcohol Screening Test (PAS), if you are over 21. The officer will state that you have to take this test but you do not unless you are on probation for another DUI conviction.

  • Be polite and stay on your best behavior, as some law enforcement agencies video tape the arrest, breath/blood testing and/or booking process.

  • Make a detailed list of all the events that led to your being pulled over for a suspected DUI, what was said or done during the traffic stop, at the police station and up until your release from custody.

  • Last and most important, you have ten (10) days including weekends, from your date of arrest to contact the DHSMV (Department of Highway Safety and Motor Vehicles) to request a DMV hearing. Your DUI attorney can request this hearing for you, as well.
